Vietnam Clarifies Local Env Inspection Powers

Vietnam has clarified the authority of local governments in enforcing environmental protection laws, confirming that commune level authorities have the right to inspect businesses for compliance. The clarification came in response to a query from a company operating in the garment sector in Dong Thap.

The Ministry of Agriculture and Environment stated that inspection powers are clearly defined under the 2020 Law on Environmental Protection and its subsequent amendments. These legal provisions authorize local authorities, including commune level administrations, to carry out specialized inspections related to environmental protection.

According to the ministry, the Chairman of the People’s Committee at the commune level has the authority to oversee and inspect compliance with environmental regulations within their jurisdiction. This ensures that environmental standards are maintained even at the grassroots level of administration.

The legal framework governing these powers is supported by additional regulations, including provisions outlined in the amended laws and Government Decree No. 217 issued in 2025. These rules establish procedures and responsibilities for conducting inspections effectively and transparently.

Officials emphasized that businesses must comply with environmental laws regardless of the level of authority conducting inspections. Companies that have received environmental permits are still subject to regular monitoring to ensure continued adherence to standards.

The clarification aims to strengthen enforcement mechanisms and ensure that environmental protection is consistently applied across all regions. By empowering local authorities, the government seeks to improve oversight and prevent violations at an early stage.

The ministry also highlighted that these measures are part of broader efforts to promote sustainable development and protect natural resources. Stronger inspection authority at the local level is expected to enhance accountability and environmental governance nationwide.
