A sessions court in Johor Bahru has sentenced a 39-year-old man to 10 years in prison and five strokes of the cane after he admitted to raping a woman with disabilities in Skudai. The case has drawn attention to the vulnerability of persons with disabilities and the need for stronger protection.
The accused, identified as R. Sivanesan, pleaded guilty to the charge, which was read out in court. According to case details, the victim was a 29-year-old woman with hearing, speech, and learning impairments, making her particularly vulnerable to exploitation.
The crime took place at a residence in Skudai late at night on January 30. Prosecutors highlighted that the accused was fully aware of the victim’s condition and deliberately took advantage of her, which qualifies the offence as aggravated rape under Malaysian law.
The court also took into account serious public health concerns, as the accused is HIV-positive, thereby exposing the victim to potential health risks. The prosecution stressed the need for strict punishment, citing both the severity of the crime and the broader public interest.
In addition to the prison sentence and caning, the court ordered the accused to undergo rehabilitative counselling during his imprisonment. He will also remain under police supervision for one year after release, reflecting efforts to prevent repeat offences and ensure accountability.
