Francesca Albanese, the UN Special Rapporteur on the Occupied Palestinian Territories, has expressed profound concerns regarding India’s enduring political and military partnerships with Israel. She argues that these connections might contravene international law. In a recent interview, she emphasized legal obligations stipulated by the International Court of Justice, asserting that nations should refrain from military and trade interactions with states accused of illegal occupation.

Albanese disclosed her insights in a report titled “Torture and Genocide,” presented to the United Nations Human Rights Council. Within this document, she claimed that Palestinians have endured systematic torture since October 2023, particularly in Gaza, describing the area as resembling a “massive torture facility.” The report points to widespread arrests, including that of minors, alongside thousands of reported disappearances, and details severe conditions of detention, mistreatment, and deprivation of fundamental rights.

In her commentary on India, Albanese warned that persistent engagement with Israel, particularly concerning defense and politics, could infringe upon international legal obligations. She suggested that such collaboration might perpetuate a wider cycle of violence and potentially undermine the global legal framework regulating international relations.

Additionally, she claimed that torture transcends prisons, permeating everyday life manifested through surveillance and movement restrictions in Palestinian territories. The report contends that these practices foster an atmosphere of relentless pressure and coercion.

Albanese also connected her worries to broader implications for global accountability, noting that several nations have already initiated legal or diplomatic measures to tackle similar issues. She urged the international community to uphold legal norms and ensure accountability in light of alleged violations.

Her statements have intensified the ongoing global discourse regarding the circumstances in Gaza and the duties of countries like India that maintain relationships with Israel. This issue is notably intricate, spanning legal interpretations, diplomatic ties, and varied international views on the conflict.
