In a significant legal step, Hikvision, the renowned Chinese surveillance firm, has revealed that its U.S. branch is taking action against a new rule from the Federal Communications Commission (FCC) that tightens regulations on telecommunications devices produced in China. This rule seeks to address national security issues by prohibiting new approvals for products using components from companies listed on the FCC's “Covered List” and allows for past authorizations to be revoked.
Hikvision contends that the FCC has overstepped its jurisdiction, asserting that the agency is attempting to retroactively alter valid authorizations without adequate legal justification. The firm states that its filing aims to protect its market rights while fostering a stable regulatory environment for legitimate businesses and clients.
Previously, Hikvision was among several companies, including Huawei, ZTE, China Mobile, and China Telecom, placed on the Covered List, which hinders these firms from gaining U.S. import approvals for new hardware. Recently, major e-commerce platforms have eliminated millions of listings of restricted products like home surveillance cameras and smart gadgets from these entities.
This latest legal challenge isn't Hikvision's first encounter with U.S. regulatory issues. Back in February, a U.S. appeals court dismissed the company's effort to overturn a 2022 prohibition on its video surveillance and telecom gear. The FCC's scrutiny has also extended to other organizations, notably Hong Kong-based HKT, amid rising national security concerns, indicating heightened vigilance towards foreign telecommunications providers.
Through this legal endeavor, Hikvision aims to uphold market equilibrium and advocate for the interests of its partners and customers as regulatory challenges grow increasingly intricate.
