Vietnam is preparing to introduce a new framework for specialized inspections in the healthcare sector, as the Ministry of Health Vietnam seeks public feedback on a draft circular outlining updated procedures. The proposal aims to strengthen oversight and improve efficiency across medical and health-related services nationwide.
According to the draft, the Minister of Health will have the authority to conduct specialized inspections within the scope of state management. Heads of departments under the ministry will also be empowered to inspect organizations and individuals based on delegated responsibilities, while local-level inspections will follow existing regulatory provisions.
The draft emphasizes the importance of structured planning, requiring inspection units to develop thematic inspection plans aligned with socio-economic goals and sectoral management needs. These plans will be consolidated and submitted for approval, ensuring coordination and avoiding duplication across agencies.
Inspection decisions will be issued by competent authorities based on legal provisions, and inspection teams will be formed with representatives from relevant bodies. The process ensures transparency and accountability in assigning responsibilities and conducting inspections.
The proposal also outlines clear rules regarding inspection timelines and locations. Inspections will generally last no more than 15 days, with a possible extension of up to 7 days in complex cases. Advance notice must be given to inspected entities, except in cases where surprise inspections are necessary to prevent concealment of violations.
During inspections, teams will assess compliance with healthcare laws and regulations, review documents, and request explanations when required. The process includes both in-person and online inspection methods, reflecting a modern and flexible approach to regulatory enforcement.
The draft also proposes multiple options for defining inspection content, covering areas such as medical services, disease prevention, pharmaceuticals, food safety, health insurance, and medical infrastructure. This comprehensive approach is expected to enhance governance and ensure higher standards across Vietnam’s healthcare system.
