Thailand’s Department of Labour Protection and Welfare (DLPW) has reminded employers to correctly pay overtime and compensation to security guards under a new ministerial regulation that will come into effect on April 24, 2026.
The regulation was earlier published in the Royal Gazette in April 2025 and aims to strengthen labor protection standards, especially for employees working as security guards or those assigned similar duties as part of their regular work.
According to the Director-General of the department, the new rule is designed to ensure that employees receive fair and appropriate wages in line with the current economic conditions and the nature of their work responsibilities.
Under the new regulation, employers who assign overtime work must pay workers at a legally defined rate. On normal working days, employees must be paid at least 1.25 times their hourly wage for overtime work, while on holidays the rate must be at least 2.5 times the hourly wage.
The rule also applies to employees who are not paid on a monthly basis, ensuring that all workers performing security-related duties are covered under the same standards of compensation.
The regulation further allows employers and employees to mutually agree on working hours exceeding eight hours per day, but the total working time must not exceed 48 hours per week as per legal limits.
Any work performed beyond eight hours in a day must be compensated at overtime rates, ensuring that employees are fairly paid for additional hours worked.
Authorities have also advised that employees can file complaints if employers fail to comply with the law. Complaints can be made through provincial labour offices, official online platforms, or dedicated hotline services provided by the department.
The DLPW has emphasized that strict compliance with the new regulation is important to improve working conditions and ensure fair treatment for security guards and similar workers across the country.
