Ontario Appeals Order to Disclose Ford’s Private Call Logs

The legal team representing Ontario Premier Doug Ford is contesting a significant transparency ruling that could mandate the release of call logs from his personal phone. They argue in court that this order is built on incorrect assumptions and raises the specter of a cumbersome administrative load on the province.

A three-judge panel convened on Wednesday to assess the Ontario government’s response to a decision issued by the Information and Privacy Commissioner (IPC), which indicated reasonable grounds to believe Ford utilized his personal phone for matters related to government business.

Advocacy groups for disclosure argue that allowing a premier to manage public affairs via a personal device without oversight undermines principles of open governance and diminishes democratic practices. They contend that Ford shouldn't evade transparency simply by using a private line.

The IPC’s ruling, expected in late-2024, was issued following freedom-of-information requests aimed at acquiring access to the premier’s call logs. The adjudicator deemed it “logical and probable” that Ford conducted government-related discussions on his private cellphone, particularly since he has a history of publicly sharing his number at public events.

The decision concluded that certain calls are likely connected to official responsibilities, thus making parts of the logs subject to public record scrutiny. In response, the government quickly filed an appeal, asserting that the ruling excessively emphasizes transparency while downplaying the privacy rights enshrined in provincial laws.

Recently, Ford acknowledged a significant influx of incoming calls, urging organizations to streamline communications through designated contacts. His legal representatives assert that the IPC’s directive is unprecedented and poses concerns for numerous public employees who occasionally utilize personal devices.
