A court in Hangzhou, China, has delivered an important judgment stating that companies cannot dismiss employees simply to replace them with artificial intelligence. The ruling is being seen as a significant step in protecting workers in the age of rapid technological change.
The decision was given by the Hangzhou Intermediate People's Court while hearing a case involving a senior employee who was removed from his position after his work was automated using AI tools. The employee had been working in a technical role focused on managing and improving AI outputs.
According to the case details, the company attempted to move the employee to a lower level position with a major salary cut after introducing automation. When the employee refused to accept the new role, the company decided to terminate his employment.
The employee challenged the decision and took the matter to arbitration. The arbitration panel ruled in his favor and stated that the dismissal was not justified under the law. The company later appealed the case in court, but the final ruling supported the employee.
The court clearly stated that replacing human workers with AI does not count as a major change in working conditions under labor laws. It also noted that the company failed to prove that it was impossible to continue employing the worker.
The judges further observed that the alternative job offered to the employee was not reasonable. A significant reduction in salary and position cannot be considered a fair adjustment, especially when the employee has not agreed to such changes.
The ruling also emphasized that companies must follow proper procedures before making such decisions. This includes discussing changes with employees, offering training, and exploring suitable alternative roles within the organization.
This case is not the first of its kind in China. Similar decisions have been made earlier, where courts ruled that automation is a business choice and not a valid reason to dismiss employees without proper justification.
The judgment comes at a time when many global companies are adopting AI to reduce costs and increase efficiency. However, this ruling highlights the need to balance technological progress with employee rights and fair treatment in the workplace.
